Terms of Service

1. Agreement to Terms

By accessing or using konti.bot ("Service"), operated by konti.bot ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

konti.bot is an AI-powered content automation platform that provides:

  • Content Research — automated company analysis, competitor research, and market insights using AI agents
  • AI Influencer Personas — generation and management of AI-created influencer profiles for content strategy
  • Content Idea Generation — AI-driven storyboard and content brief creation based on competitor analysis
  • Video Production — automated video generation using AI avatars, stock footage, and AI quality review
  • Interactive Research Chat — conversational AI interface for brand research and content planning

3. Account Registration

To use the Service, you must create an account through our authentication provider (Clerk). You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must provide accurate and complete information during registration.

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws
  • Upload content that infringes on third-party intellectual property rights
  • Attempt to reverse-engineer, decompile, or disassemble any part of the Service
  • Use the Service to generate misleading, deceptive, or fraudulent content
  • Violate the terms of service of any third-party platform (including Instagram, TikTok, or Twitter/X) when using content produced by the Service
  • Impersonate real individuals through AI-generated personas without their consent
  • Upload or provide brand assets you do not have the right to use
  • Circumvent any access controls or usage limits
  • Use automated tools to scrape or extract data from the Service

5. User Content & Intellectual Property

5.1 Your Content

You retain ownership of all content you provide to the Service, including company descriptions, brand assets, URLs, and instructions. By providing content, you grant us a non-exclusive, worldwide license to process it as necessary to deliver the Service.

5.2 AI-Generated Content

Content generated by the Service (influencer personas, storyboards, scripts, videos) is owned by you. However, AI-generated content is provided "as-is" and may require your review before publication. You are solely responsible for ensuring that any content you publish complies with applicable laws and platform policies.

6. AI-Generated Content Disclaimer

Content produced by AI agents, including but not limited to influencer personas, content ideas, storyboards, scripts, and videos, is generated using machine learning models. We do not guarantee the accuracy, completeness, or suitability of AI-generated content. The Service does not guarantee specific outcomes such as engagement, followers, or revenue.

7. Third-Party Services

The Service integrates with third-party providers to deliver its features:

  • OpenAI — AI reasoning and content generation
  • Google Gemini — video analysis and content classification
  • HeyGen — AI avatar video production
  • Pexels — stock footage for video B-roll
  • Clerk — authentication and account management
  • Convex — database and real-time backend
  • Backblaze B2 — media file storage

Your use of these third-party services is subject to their respective terms. We are not responsible for any third-party service outage or data handling.

8. Social Media Platform Compliance

You are responsible for complying with the terms of service of any social media platform where you publish content generated by the Service. konti.bot does not guarantee that AI-generated content will comply with all platform policies. Posting AI-generated content that violates platform terms may result in your accounts being restricted or banned by those platforms, and we bear no liability for such outcomes.

9. Service Availability & Modifications

We strive to maintain high availability but do not guarantee uninterrupted access. We reserve the right to modify, suspend, or discontinue any part of the Service at any time. We will make reasonable efforts to notify you of significant changes.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KONTI.BOT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless konti.bot, its officers, employees, and agents from any claims, damages, or expenses arising from: (a) your use of the Service, (b) your violation of these Terms, (c) content you publish using the Service, or (d) your violation of any third-party rights.

12. Termination

We may terminate or suspend your account at our discretion if you violate these Terms. You may delete your account at any time. Upon termination, your right to use the Service ceases immediately. We may retain certain data as required by law or for legitimate business purposes.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on the Service with a new effective date. Your continued use of the Service after changes constitutes acceptance of the updated Terms.
